What is Probate?

Probate is the legal process of dealing with the estate (money, property, possessions) of someone who has died. A Grant of Probate, issued by the court, gives the executors named in the will the authority to manage the estate.The probate application involves valuing the estate, paying any inheritance tax, and distributing the assets. This is done according to the will or the rules of intestacy if there isn’t one

Probate isn’t always required but if the deceased had property or more than £5000 – £10,000 in a bank then you will most likely need probate. There are exceptions for the type and value of the assets. For instance, if the deceased and another person held all assets as joint tenants, those assets will automatically pass to the survivor. The probate process can take anywhere from a few months to several years, depending on how complex the estate is and whether there are any disputes that need to be resolved. On average, it can typically take 6-12 months to receive an inheritance.
Whilst hiring a lawyer is not required, it is often highly advisable, especially if there is a complicated estate or if beneficiaries do not agree. A good probate lawyer can help you navigate the probate process efficiently while avoiding costly mistakes.
Typically, there’s no inheritance tax on estates below £325,000 value (or £500,000 in certain circumstances). For anything above this value you will usually pay 40% tax although you may still be able to claim additional exemptions/reliefs. Our team can guide you through your specific circumstances
